What is the difference between intestate and testate succession?
Intestate succession and testate succession are two very different ways of handling estate planning in Florida. Intestate succession is the process of distributing the property and assets of an individual who has died without a will or other written instructions. On the other hand, testate succession is the process of distributing the property and assets of an individual who has died with a will or other written instructions. In these cases, the deceased’s instructions as written in the will are adhered to and the property and assets are distributed as directed. If for some reason the will is ruled as invalid, the distribution of property and assets will go back to being determined under the intestate succession laws. Both intestate succession and testate succession are regulated by the state of Florida, but they differ in the instructions used to determine how to distribute the deceased’s property and assets. In the case of intestate succession, the state’s laws are used to determine how the property is divided among the deceased’s family and other heirs. In the case of testate succession, the deceased’s written instructions are used to determine how the property and assets should be distributed.
