What happens to the assets in an intestate estate after the death of the deceased?

When a person dies without a will in Minnesota, their assets are distributed according to state law called intestate succession law. Under this law, the assets of the deceased are divided among their heirs, which is determined by their relationship to the decedent. The first to inherit the estate are the surviving spouse and children. If the decedent has a surviving spouse, they will receive all of the estate if there are no children; however, if there are children, the spouse will receive a portion. If the decedent does not have any children or a surviving spouse, the estate will be distributed among other relatives, including parents, siblings, or more distant relatives. If there are no living relatives, the state of Minnesota will take possession of the intestate estate. In some cases, a personal representative may be appointed to manage the estate. They will be responsible for collecting, valuing, and distributing the assets. They must also file a petition for the appointment of a personal representative, inventory the deceased person’s assets, and pay creditors and expenses. The personal representative will distribute the assets according to the Minnesota intestate succession law. This will involve selling certain assets, such as real estate, and distributing the proceeds to the heirs. Other assets, such as a car, may be distributed directly to the heirs. Once the assets are distributed, the personal representative will file a final accounting with the probate court to close the case and settle the deceased person’s estate.
