What happens to debts in an intestate estate?

When an individual dies without a will, it is known as dying intestate. When someone dies intestate in Minnesota, the intestate succession law will determine who will inherit their assets and how much they will receive. But what happens to the debts? In Minnesota, debts take precedence over an inheritance. In other words, when an individual who died intestate owed debt, it must be paid first before any assets can be distributed to the heirs. The executor of the estate will be responsible for distributing the assets to creditors before distributing the remaining assets to the heirs. Creditors have the right to notify the executor where their debt is owed. It’s the executor’s responsibility to pay debts of the estate in a specific order, within the limits of the assets that are available. The executor should be aware of which creditors to pay first. Once the debts are paid, the executor of the estate will divide any remaining assets among the heirs in accordance with the state’s intestate succession laws. In Minnesota, the law states that assets are passed to the surviving spouse first, followed by the children. Other relatives may receive assets as well, depending on who is closest to the deceased. It’s important for executors to understand the state’s intestate succession laws and how to properly distribute assets to creditors, before distributing them to the heirs. Understanding the laws can help ensure the accuracy and fair distribution of assets in an intestate estate.
