Can an intestate succession be appealed?
In Nevada, an intestate succession can generally be appealed if the court makes a mistake. For example, if the court incorrectly interprets the law when determining who is entitled to receive a deceased’s property, a party in the proceedings can file an appeal. The appeal process begins when the appellant—the person or group filing the appeal— provides a concise explanation of why they believe the court committed an error. It is important to remember that the court’s decision does not have to be wrong for it to be reversed by the judge in the appellate court. The appellant must prove that the mistake was made in how the law was applied. The appeal must be filed within 30 days of the court’s ruling. The appellant must provide the reasons for the appeal to the court as well as the necessary fees, including filing fees and fees for service of process. The appellant must also provide the court with a copy of the original order regarding the intestate succession. The appeal will be heard by a panel of three judges in the appellate court. After hearing both sides of the argument, the panel will issue a decision. If the court agrees that the original decision was not in accordance with the law, they may reverse the decision and issue a new ruling. Otherwise, the original order will stand.
