What is the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs)?
The WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) is an international agreement that’s a part of the World Trade Organization (WTO) legal framework. This agreement was adopted by the WTO’s member states in 1994 and establishes a set of global standards for the protection of intellectual property. Under the TRIPs agreement, countries must provide a certain level of protection to various types of intellectual property including copyrights, trademarks, patents, trade secrets, and geographical indications. The TRIPs agreement ensures that each WTO member’s intellectual property protection laws meet a minimum global standard by preventing any country from treating foreign intellectual property less favorably than domestic creations. Additionally, the agreement also creates incentives and facilitates cross-border trade in intellectual property. In North Carolina, the TRIPs agreement applies to intellectual property-related issues such as technology transfer, international licensing, trade secret protection, and other related matters. In addition, North Carolina has adopted additional laws to govern the use and protection of intellectual property, in compliance with the TRIPs agreement. North Carolina also closely follows the standards set by the TRIPs agreement in determining how to address claims of infringement of intellectual property rights.
