What is the process for filing a petition for juvenile delinquency?

In Oregon, if a juvenile is accused of an offense, their case may be handled in juvenile court. To initiate this process, a petition for juvenile delinquency must be filed. This petition is filed by the local district attorney’s office, and it outlines the juvenile’s alleged criminal behavior. The petition is then presented to a juvenile court judge. The judge may decide to proceed with the case or refer it to a special program or alternative sentencing. If the judge decides to move forward with the case, the petition is then referred to the court counselor or probation officer who will create a “court report”. This report is an evaluation of the facts and circumstances of the case as well as the juvenile’s family and social background.
