Who can access juvenile court records?
In California, the juvenile court records are confidential and restricted from the public. Generally, the only individuals who can access juvenile court records are the juvenile, their parent or guardian, or their attorney. In addition, various state and local government agencies have access to the records if they are performing law-enforcement or child welfare-related duties. In some cases, such as when a juvenile is charged with a serious felony offense and is certified as an adult, the court may order that their juvenile records be opened to the public. If this happens, the adult criminal records will be available to anyone who requests them. In other cases, the court may issue an order to have the juvenile record made available to the public, such as when they have been charged with a sex offense. In some cases, the court will order that the juvenile’s records be kept confidential, such as when a juvenile is engaged in a confidential program or is attending a school for troubled youth. It is important to note that any records that are sealed or expunged by the court will not be accessible to the public, even if the juvenile is charged with a crime or has been certified as an adult.
