What are the different types of juvenile court hearings?
In South Carolina, juvenile courts can hold different types of hearings to address the conduct of juveniles. The most common hearing is an adjudicatory hearing, which is similar to a trial. At the hearing, both sides present evidence and witnesses to make a case for the juvenile’s guilt or innocence. An adjudication hearing is held when the juvenile has been charged with a crime or a delinquency offense, such as truancy or running away. A disposition hearing is held after the adjudicatory hearing. During the disposition hearing, the judge decides what kind of punishment or rehabilitation the juvenile should receive. The judge looks at the degree of the crime, the likelihood that the juvenile will commit a crime again, and other factors. A transfer hearing is held when the juvenile is 13 or 14 years old and the prosecutor wants to transfer the case to adult court. The judge decides if the case should be transferred on the basis of the particular facts of the case and the juvenile’s age and maturity. A review hearing is held to review the progress of the juvenile’s rehabilitation program, which is ordered during the disposition hearing. The judge evaluates how the juvenile has been progressing and decides if it’s necessary to modify the program. Finally, if the juvenile has been placed in a secure facility, like a detention center, a release hearing is held to determine if the juvenile should be released. The judge looks at the juvenile’s progress and behavior to decide if they can be released into the community.
