What is the Worker Adjustment and Retraining Notification Act (WARN)?
The Worker Adjustment and Retraining Notification Act (WARN) is a federal law that requires employers in the United States to provide employees with advance notice of certain workplace changes. These changes include plant closings, relocations, and layoffs of large numbers of employees. WARN was enacted in 1988 to provide workers with more time to readjust to the impact of these significant workplace changes. Under WARN, employees must be given at least sixty (60) days advance notice of termination or plant closing in order to allow time to obtain new employment or make plans for their future. In North Dakota, WARN applies to employers with 100 or more employees. An employer must provide notification to affected employees, as well as to the state’s dislocated workers unit and the local government. WARN also requires employers to provide payment for lost wages and benefits to all affected employees. In North Dakota, employees may be entitled to up to a maximum of twenty (20) weeks of severance pay, which is calculated at the employee’s rate of pay at the time of termination. In North Dakota, WARN also applies to private employers and governmental organizations engaging in temporary or seasonal employment if they employ 100 or more regular employees and realize a net loss of volunteers, employees, or contractors due to the seasonal services or operations.
