What is the law regarding late fees and other charges?
In Iowa, an individual who leases a property must follow the state’s laws related to late fees and other charges. According to Iowa Code § 562A.7A, a landlord can charge a reasonable late fee for any rent payments that are received more than five days after the due date. The late fee cannot exceed ten percent of the actual rent charged. In addition, a landlord can charge a reasonable fee for any returned checks, bounced checks, or other payment methods that are not honored. Apart from late fees, a landlord in Iowa is also allowed to charge a security deposit as a form of protection and risk management for the property. However, the amount charged cannot exceed two times the amount of rent. All security deposits must be returned within 30 days of the termination of the lease agreement. Additional charges that a landlord in Iowa may impose include charges for repairs due to damages caused by the tenant, legal fees, and other costs associated with tenant’s lease violations. As such, landlords must provide clear documentation of such fees and charges in order to ensure that they are recoverable from the tenant.
