What types of rental agreements are legally binding?

In North Dakota, rental agreements, also called leases, are legally binding contracts between a landlord and a tenant. Generally, two types of rental agreements are legally binding: fixed-term and month-to-month. A fixed-term agreement, also called a lease, is a contract for a specific period of time. The lease will outline what the tenant agrees to pay over the term of the agreement, the amount of the security deposit, and any other rules of the property. A fixed-term lease is legally binding for the length of time stated in the agreement. A month-to-month rental agreement is legally binding and much more flexible than a fixed-term agreement. This agreement has no end date, and the tenant will pay rent on a month-to-month basis. The month-to-month agreement will outline what the tenant agrees to pay each month, the amount of security deposit, and any other rules of the property. The rights of tenants are protected by the North Dakota Residential Landlord and Tenant Act. It’s important for both landlords and tenants to be familiar with the act and to be aware that any rental agreement they enter into must comply with the applicable laws.
