What happens if a tenant fails to pay rent?
In Georgia, failing to pay rent is a breach of the lease agreement. If tenants fail to pay rent, the landlord has the right to begin the legal eviction process. First, the landlord must serve the tenant with a 3-day notice to either pay the rent or vacate the property. If the tenant does not comply with the notice, the landlord can begin the eviction process. The eviction process is thorough and can take several weeks. The landlord will need to file the appropriate paperwork with the court and arrange to have the papers served on the tenant. Generally, the tenant will be given 7 to 30 days to respond. If the tenant contests the eviction, the landlord may be required to appear in court. If the tenant does not respond within the allotted time frame or fails to appear in court, the landlord will be granted a judgment of possession. The landlord will then need to arrange for a deputy sheriff to serve the notice of eviction and to physically remove the tenant from the property. The tenant will be given 24 hours to vacate the premises and will be responsible for paying the court costs associated with the eviction. With a court order, the tenant may be subject to a forcible eviction if they still do not leave after 24 hours.
