What happens if a tenant fails to pay rent?

If a tenant fails to pay rent in North Dakota, the landlord may begin the eviction process. The court will serve the tenant with a notice according to the state’s landlord-tenant law. Depending on the situation, the tenant may be given a three-day pay or quit notice or a seven-day notice that requires the tenant to leave the property. If the rent is not paid on or before the specified time period, the landlord may file an eviction lawsuit. Once an eviction lawsuit is filed, the tenant will receive court documents regarding the case. The tenant will then have a chance to defend their case before a judge. They must follow the proper court process and use a sheriff or constable to physically remove the tenant from the premises. After the tenant is removed from the property, the landlord may then file for a money judgment against the tenant for the amount of unpaid rent. The landlord can take legal action to collect the money owed, such as garnishing the tenant’s wages or placing a lien on their property.
