How a tenant can get their security deposit back after moving out?

After a tenant moves out of a rental property in North Carolina, they are able to get their security deposit back in the following ways. The tenant must first provide the landlord with their current mailing address. The tenant must also complete a Security Deposit Refund Form, which is available online for free. This form must be sent to the landlord within 30 days of the end of the tenancy. The landlord then has 30 days to respond to the tenant with either a refund of the security deposit or a list of deductions and the remaining balance. The landlord must also provide the tenant with an itemized list of deductions, if any. This list must be provided within the 30-day period and must explain why each item was deducted from the security deposit. If the landlord fails to respond to the tenant within the 30-day time period, the tenant is able to file a complaint with the Consumer Protection Division of the North Carolina Department of Justice. In addition to providing the needed paperwork and itemized list of deductions, if applicable, the landlord must also return the security deposit directly to the tenant. The landlord must deposit the amount due into the tenant’s account or send a check to the tenant within the 30-day period. If the landlord does not comply with these regulations, the tenant may take legal action.
