How a tenant can get their security deposit back after moving out?

When a tenant moves out of a leased property in North Dakota, they are entitled to the return of their security deposit. However, before the deposit can be returned, the tenant must initially provide the Landlord with a forwarding address where the security deposit can be mailed to. Additionally, the tenant must also provide the landlord with written notice that the tenancy has ended. The tenant should then keep an eye out for the return of the security deposit as North Dakota law requires the landlord to return the security deposit within 30 days of the tenant giving notice that they have ended the tenancy, or within 30 days of the tenant moving out, whichever is later. If the landlord does not return the security deposit or an itemized list of deductions, the tenant should contact the landlord and request it. If the landlord still does not comply, the tenant may file a complaint with the North Dakota Real Estate Commission. If the landlord decides to deduct an amount from the security deposit, then they must provide the tenant with an itemized list of deductions clearly outlining why those deductions were made and the total amount the tenant can expect to receive from the deposit. Once the landlord has complied with sending the security deposit or an itemized list of deductions to the tenant, the tenant should check the details for accuracy and ensure they have received their deposit in full. If anything appears to be incorrect, the tenant should contact the landlord immediately.
