What is the difference between premises liability and liquor liability?
Liquor liability and premises liability are two distinct legal concepts. Though they may be related in some cases, they are not the same. Premises liability relates to a property owner’s responsibility to keep their premises (land or building) safe for visitors. This means providing a safe environment free of any hazards that could cause injury, and if injury does occur, the property owner may be liable for damages. Liquor liability law, on the other hand, relates to a business’s responsibility to ensure that alcohol is not abused or consumed by minors or in such a way that someone else is injured. This could involve an establishment being held liable if they serve alcohol to someone who is already intoxicated or to a minor. In Nevada, a business may be held liable for damages caused by a person’s intoxication if that person is served alcohol at that establishment. If a property owner is found to be liable, they may be responsible for the injuries or damages caused to a person or property. Ultimately, the difference between premises liability and liquor liability is that the former applies to a property owner’s responsibility to ensure that their premises are safe for visitors, while the latter applies to an establishment’s responsibility to ensure that it does not serve alcohol to minors or to anyone who is already intoxicated. Both are important considerations of the law that businesses should be aware of in order to protect their customers and themselves.
