In Nevada, liquor liability law has special regulations related to selling alcohol in a drive-thru. Drives thru liquor sales must abide by state regulations which include not selling to intoxicated customers or minors as well as abiding by local laws. Additionally, the seller must obtain a drive-thru liquor license and comply with all the requirements associated with such a license. Drivers must not be able to access the trunk of the vehicle and must remain in their vehicle at all times. Customers are prohibited from removing alcohol purchased through a drive-thru from the vehicle until it is parked in another designated area. The drive-thru must have a secure system such that customers must have a previously purchased identification in order to purchase alcohol. Moreover, the driver must remain in their vehicle until the purchase is completed. Minor customers may not pass through the drive-thru for any purchases, even non-alcoholic beverages. Furthermore, liquor must be sold in a container designed to hold no more than three liters, and for spirits only, the container must be resealable. The drive-thru must have an employee present at all times, who is trained to recognize signs of intoxication and to enforce legal restrictions on drive-thru sales. The employee must also be able to take possession of the driver’s identification in order to ensure that the customer is of legal drinking age.
