What is the difference between federal, state and local law?
The laws of the United States are divided into three general categories: federal law, state law, and local law. Federal law governs all U.S citizens and territories, and applies to issues including but not limited to immigration, foreign policy, and trade. State law governs citizens and their activities within the boundaries of a particular state. Examples of state law include taxation, criminal, and civil law. Local law applies to issues within a specific geographic area, such as a city, county, or other local government jurisdiction. In Florida, local law is determined by local governing bodies, such as counties, municipalities, school districts, and other special districts. Federal laws are based on the U.S Constitution and the laws passed by Congress. These laws are enforced by the federal government and the federal courts. State law is created through the state legislature, court decisions, and executive orders; state laws must not conflict with federal law. Local laws are usually enacted by the local governing body, such as a city council, school board, or county commission. Local laws are also known as ordinances and must be consistent with both federal and state law. In sum, federal law applies across the entire United States and is created based on the U.S Constitution, while state law applies strictly to each individual state. Finally, local law applies within a specific geographic area such as a city, county, or district.
