How are intergovernmental agreements handled?

An intergovernmental agreement (IGA) is a document drafted by two or more governments that outlines the responsibilities of each government when it comes to a particular topic or piece of legislation. In Florida, IGA’s are handled in a few different ways. One way is through state authorization of a local government to enter into an IGA. This requires the local government to notify the state of its intention to enter into the IGA as well as provide information about the IGA’s term and purpose. The state then has the authority to approve or deny the IGA. Another way IGA’s are handled in Florida is through the direct authorization of a state agency. Certain state agencies, such as the Florida Department of Transportation or the Florida Department of Education, are authorized to enter into IGA’s with local governments. In this scenario, the local government would submit a request to the agency, outlining the terms of the agreement, and the state agency would decide whether or not to approve the IGA. Finally, in some cases, two or more local governments may enter into an IGA without state authorization. In these scenarios, both local governments must follow the provisions of applicable law, such as the Sunshine Law, to ensure that the agreement is adopted in a fair and transparent manner. In addition, local governments must ensure that they have the legal authority to enter into the IGA before it is authorized.
