How are intergovernmental agreements handled?

Intergovernmental agreements are handled in Kansas with the Intergovernmental Cooperation Act (ICA). This act, which was enacted in 1945, is a tool used by local governments to work together to provide services and resources. Under the ICA, two or more local governments may enter into agreements that allow them to share resources, equipment, facilities, personnel, and other services. The ICA defines the process for creating an intergovernmental agreement, including the negotiation between the local governments involved, the establishment of a Memorandum of Understanding, the approval of the agreement by the governing bodies of each local government, and the establishment of a Governing Authority to oversee the agreement. This Governing Authority is usually made up of members from each of the local governments involved or appointed by the local governments. The ICA also outlines general regulations for intergovernmental agreements, such as setting the terms and conditions of the agreement, determining how much each local government will contribute to the agreement, and providing a termination or amendment clause in case either party wishes to make changes. Intergovernmental agreements can provide local governments with the ability to work together on projects and services that could not be accomplished independently. These agreements provide an efficient and cost-effective way to pool resources, protect local communities, and promote economic development in the state.
