How are intergovernmental agreements handled?

In Texas, intergovernmental agreements are handled by a process known as “cooperative agreements” or “interlocal contracts.” These agreements are legally binding contracts between two or more governmental entities, such as a county and a municipality, or between two counties. Interlocal agreements are used to secure goods and services, provide funding, and to pool resources for projects or services. The Texas Legislature has passed legislation that allows county and municipality governments to enter into cooperative agreements. This legislation serves to strengthen local government’s ability to plan, finance, and provide services to the public. Before entering into an interlocal agreement, local governments must pass a resolution or ordinance granting permission. Additionally, the resolution or ordinance must include specifics like the parties involved, a term for the agreement, a description of the purpose, as well as grant authority for the governing body to enter into the agreement. Once the resolution or ordinance has been passed, the two local governments can enter into the intergovernmental agreement and be legally bound by the terms therein. Furthermore, the Texas Public Information Act ensures that any documents associated with an interlocal agreement, such as contracts, resolutions, and minutes, are available to the public. The policy of transparency ensures that citizens are aware of how their local governments are spending public money.
