What is the legal framework for public sector employment and labor relations?
Public sector employment and labor relations in Washington are largely governed by state and federal labor laws. These laws were created to ensure fair wages and working conditions for public sector workers, as well as to protect their rights as employees. In Washington, Chapter 41.56 of the Revised Code of Washington (RCW) provides the legal framework for public sector employment and labor relations. This chapter covers a variety of topics such as collective bargaining, unfair labor practices, and the resolution of disputes between government agencies and their employees. In addition, the Washington State Board of Industrial Insurance is responsible for setting the minimum wages and other labor standards for public sector employees. Washington also has several laws that protect public sector employees from discrimination and harassment. For example, the Washington State Civil Rights Act prohibits employers from discriminating against their employees based on race, color, religion, national origin, sex, sexual orientation, military status, age, marital status, or disability. In addition, the Washington State Law Against Discrimination also protects employees from discrimination and harassment based on sexual orientation. Finally, the Washington State Employee Relations Act (ESRA) gives public sector employees the right to engage in collective bargaining and the right to form and join labor unions. The ESRA also creates a system of mediation and arbitration for resolving disputes between the government and its employees.
