Yes, there are laws related to the disposal of hazardous materials in the state of Texas. Hazardous materials are any materials that are toxic, corrosive, explosive, and/or flammable. In order to safely and legally dispose of these materials, there are a variety of specific regulations in place. The Texas Health and Safety Code contains the regulations all businesses must follow in regard to the handling and storage of hazardous materials. Businesses must secure the materials to prevent loss, tampering, fire or contamination. Additionally, the Department of State Health Services is responsible for implementing regulations for the safe disposal of these materials. Businesses must also register with the state before they initiate the collection or disposal of hazardous materials. After registration, the business must obtain a permit to store and/or transport hazardous materials. The State Department of Health also requires periodic testing and reporting of hazardous materials to be reported to the state every six months. When disposing of hazardous materials, businesses must follow all applicable rules and laws. This includes segregating materials to be disposed, properly labeling each volume, and hiring a licensed transporter to transfer materials to a registered hazardous waste landfill. In addition to these laws, the Texas Department of Environmental Quality also has regulations regarding the disposal of hazardous materials. The department requires businesses to recycle, reuse or properly dispose of any hazardous materials they produce in order to protect the environment and public health. Failure to comply with any of the hazardous waste disposal regulations can result in penalties or fines.
