What are the rules governing wages and overtime?

In Arizona, the rules governing wages and overtime are outlined in the Fair Labor Standards Act (FLSA) and the Arizona Minimum Wage Act. The FLSA establishes the federal minimum wage and requires employers to pay eligible employees overtime if they work more than 40 hours in one week. The Arizona Minimum Wage Act requires state employers to pay employees no less than the federal minimum wage. For employees that are eligible for overtime, they must be paid one-and-a-half times their regular rate of pay for any hours worked over 40 per week. For most nonexempt employees, this overtime premium is required regardless of the day of the week or the number of hours the employee works in a given shift. Additionally, eligible employees must be paid immediately for any hours they worked on their regular paycheck date. If employers do not pay employees for any hours worked, they may be subject to civil penalties. Arizona employers are not required to provide employees with overtime or special pay for working holidays, weekends, or nights, however, they may choose to do so as part of employee compensation and retention plans. Overall, employers are expected to abide by state and federal regulations when it comes to wage laws. Employers should ensure that they are meeting minimum wage and overtime requirements, and keep up to date on any changes in labor regulations.
