What is a union representation election?
A union representation election is a process that is used to determine if a group of employees wish to be represented by a union. In a union representation election, the employees have the right to decide whether they want to be represented by a union or not. If a majority of the employees vote in favor of a union, then the union will be the collective bargaining representative for the employees. Under North Carolina law, an employee wishing to organize a union must first file a petition for an election with the North Carolina Department of Labor. The Department of Labor will then investigate the employees’ petition and determine whether an election is necessary. If the Department of Labor determines that an election is necessary, it will then schedule the election and notify the employees of the date and time. At the election, the employees will vote on whether they wish to be represented by a union. If a majority of the employees who cast ballots vote in favor of union representation, then the union can become the collective bargaining representative for the employees. However, if a majority of the employees who cast ballots vote against union representation, then the union will not be certified as the collective bargaining representative.
