What is the process for resolving labor disputes?

Labor disputes in Tennessee are handled through the Tennessee Department of Labor and Workforce Development. The process for resolving disputes begins with filing a complaint with the department. The complaint is then reviewed by the labor-management services division to determine if it falls within their jurisdiction. If it does, the division will investigate the complaint to determine if any labor violations occurred. Based on the findings, the division will issue a decision, and the involved parties can appeal the decision if they are not satisfied. The department may also recommend the parties enter mediation if the dispute is not resolved. Mediation is the process of resolving disputes through negotiations facilitated by a third-party mediator. The mediator will work with both parties to facilitate a settlement agreement. The agreement is not legally binding, though the parties are expected to abide by the terms of the agreement. If the parties are unable to reach a settlement, the dispute can be taken to the National Labor Relations Board. The board will then conduct a hearing and issue a decision. Ultimately, the decision of the board is binding and can only be overturned by a court order.
