What is an unfair labor practice?

An unfair labor practice (ULP) is an action or practice by either an employer or a union that violates the labor laws of the state of Minnesota. These laws protect workers from a range of abuses, such as discrimination, coercion, unfair dismissal, or failure to bargain in good faith. For employers, some examples of ULPs include threats of termination, discrimination in hiring or promotion practices, and the interference with the formation or operation of a union. Unions can also be responsible for ULPs, such as unlawful strikes, conducting job actions without proper authorization, or refusing to engage in collective bargaining with an employer. In Minnesota, both employers and unions can be held accountable for unfair labor practices. Workers who think they are the victims of an ULP can contact the National Labor Relations Board (NLRB) to file a complaint. In many cases, the NLRB can investigate the allegation and take corrective action if an employer or union is found to be in violation.
