What are the rules regarding eviction?
In Massachusetts, the landlord must follow specific steps in order to evict a tenant. The landlord must provide written notice to the tenant. The notice must specify the reason for the eviction, the date the tenant must leave the premises, and any applicable deadlines. The landlord must also provide the tenant with the appropriate documents, such as a summons, complaint, or eviction notice. A landlord can only evict a tenant for valid reasons, such as a tenant not paying rent or violating the rental agreement. The landlord must also go through the court system before evicting a tenant. The tenant has the right to contest the eviction and present their case to the court. If the tenant is found to be in violation, the court will issue an eviction order that must be followed and enforced by the landlord. Evictions must also follow all local laws and regulations, such as notice periods, ways to deliver the notices, and other requirements. The landlord must also abide by the terms of the rental agreement, if applicable. If the tenant does not comply with the eviction order, the landlord may apply to a court for a writ of possession which orders the tenant to leave the premises.
