What are the rules regarding eviction?

In North Dakota, the rules regarding eviction are governed by the North Dakota Century Code (NDCC). These rules provide landlords and tenants with the legal framework for eviction proceedings. According to the NDCC, landlords must follow certain steps in order to legally evict a tenant, such as providing advance notice and giving the tenant an opportunity to resolve the issue. The notice period varies depending on the type of lease agreement. For example, a landlord may require a 30-day notice for an eviction from a month-to-month rental agreement, but could require a 90-day notice for a yearly agreement. If the tenant fails to resolve the issue or move out, the landlord may then go through the court system to file an eviction. In North Dakota, the court filing fee ranges between thirty and seventy-five dollars. The tenant is then provided with a summons and complaint describing the reasons for the eviction. If the tenant defends the eviction, the court may hear the case and make a ruling. If the tenant does not respond, the court will issue an eviction order, which allows the tenant to be immediately removed from the property. After an eviction is complete, the landlord may also seek damages for unpaid rent or other fees. They may also receive a judgment in their favor for the return of the costs of filing the eviction.
