What is the law regarding rent increases?

In Hawaii, rent increases are regulated by the state’s landlord-tenant laws. Under these laws, landlords must provide tenants with reasonable notice if they decide to increase rent. The amount of notice required depends on the amount of the rent increase. Generally, if the increase will be more than 10 percent of the current rent, the landlord must give tenants at least 60 days of notice. If the rent increase is 10 percent or less, landlords must give tenants at least 30 days of notice. In either case, the notice must include the amount of the increase and the date it will take effect. If the tenant cannot afford the increase, they have the right to move out before the increase takes effect without being responsible for paying the remainder of the rental term. Additionally, landlords may not raise rent more than once in a 12 month period and they cannot make changes to the rental agreement that would have the effect of increasing rent. Any changes to the agreement must be mutually agreed upon by the landlord and tenant. All rent increases must still be reasonable and must follow the guidelines established by the state.
