How much can a landlord raise the rent on a month-to-month lease?

In North Carolina, landlords can raise the rent on a month-to-month lease with no prior notice. The amount of the rent increase is governed by the North Carolina General Assembly. The landlord must raise the rent in accordance with the amount allowed by the General Assembly, however, the landlord is not obligated to give the tenant prior notice of the rent increase. Generally, the amount they can raise the rent is limited to the amount of the rental increase in the Consumer Price Index (CPI), as established by the U.S. Department of Labor. The amount of the increase may not exceed 10 percent of the current rent. For example, if the current rent is $500, the landlord can only increase the rent by $50. In addition, the landlord must provide a tenant with written notice of the rent increase in accordance with the North Carolina Residential Landlord and Tenant Act. The notice must include the effective date of the increase, the amount of the increase, and the amount of the new rent payment. Although landlords have the right to increase rental payments in North Carolina, the amount of the increase must be reasonable and in accordance with the North Carolina General Assembly and the U.S. Department of Labor. Tenants also have the right to receive prior written notice of the amount of the rent increase in accordance with the North Carolina Residential Landlord and Tenant Act.
