What is the tenant’s right to access the rental property after the lease has expired?
In Georgia, after a lease has expired, a tenant still has some rights to access the rental property. According to the Georgia landlord-tenant law, when a lease period ends, the tenant becomes what is known as a “holdover tenant”. This means that the tenant is allowed to stay on the property while the landlord and tenant decide what will happen next. The tenant is not required to move out but must continue to pay rent as usual. The tenant also has the right to access the premises, make repairs, and use the property as they did in the past. This status continues unless the landlord takes steps to change the tenant’s status by evicting them or negotiating a new lease agreement. However, the tenant must respect any new lease terms that the landlord decides to impose. Although the tenant has the right to access the rental property after the lease has expired, the tenant does not have a legal right to remain on the property. The landlord is allowed to charge the tenant a higher rent until the two parties reach an agreement as to what should happen next. If the tenant refuses to leave after the expiration of the rental agreement, the landlord has the right to evict the tenant. It is important to note that the landlord must still observe any notice provisions that are applicable under the law to evict the tenant.
