How is land use law enforced?
In Texas, land use law is enforced through local ordinances. These ordinances must be approved by local governments, with guidance from the state. Each county or city may have a different set of ordinances, tailored to the needs of the local community. The most common way to enforce land use law is through zoning laws. Zoning laws are used to control how land can be used – for example, what can be built on it, what activities can take place on it, and how it can be developed. To ensure that zoning laws are followed, local governments send inspectors to sites to make sure everything is being done according to the zoning regulations. In addition to zoning laws, local governments can also regulate land use through building codes. Building codes regulate the design, construction, and maintenance of buildings in order to protect the safety of the public. If someone violates a building code, the local government can take action to make sure the code is followed, such as forcing the owner to make necessary repairs or demolish the building. Finally, local governments can use permits to regulate land use. Permits allow the government to monitor the activities of individuals and businesses, making sure that they are complying with land use regulations. If someone is found to be in violation of a permit or ordinance, the government can impose fines, suspend or revoke permits, or even take legal action.
