How is a land use ordinance different from a zoning ordinance?
A land use ordinance and a zoning ordinance are both tools used to control land development and usage in Pennsylvania. However, the two instruments are quite distinct from one another. A land use ordinance is a legal document that is much broader in scope than a zoning ordinance. It defines the use of all land within the jurisdiction of a given municipality, county, or state, regardless of the zoning that may be applied to a particular property. It defines the type of uses (residential, commercial, etc.) that are allowed on a particular parcel, as well as other regulations such as height restrictions and building setbacks. Zoning ordinances are most often used to control the types of development which is allowed in residential neighborhoods. The main purpose of these two ordinances is to protect the rights of property owners, as well as to promote public health and safety. By using land use ordinances and zoning ordinances, Pennsylvania is able to ensure that its citizens are able to enjoy safe and livable environments, while also ensuring that development is conducted in a manner that is beneficial for the community as a whole.
