How is the impact of a development project assessed in land use law?
In land use law, the impact of a development project is assessed before the project can be approved. The purpose of this assessment is to identify the effects the project will have on the public and the environment and to determine if it is beneficial. The New York State Environmental Quality Review Act (SEQRA) is the main law used to evaluate the environmental impacts of a proposed project. In order to begin the SEQRA process, the development project must first meet certain criteria. If the project satisfies these criteria, the reviewing agency then evaluates the potential impacts of the proposed project. This includes an assessment of the potential effects on air and water quality, noise levels, land use, visual aesthetics, and other related issues. In addition to SEQRA, New York also has the State General Municipal Law, which requires a Local Impact Statement to be submitted. The Local Impact Statement is a document that identifies and evaluates the potential impacts of a proposed project, such as traffic, noise, and safety. Ultimately, the decision on whether to approve a development project depends on the assessment of the potential impacts. If the impacts are deemed to be positives, the project may move forward. If the impacts are considered to be negatives, then the project may be denied or modified to address the negative impacts. It is important that local governments consider both the environmental and social impacts that a project may have before approving the project.
