In New York, the legal process for obtaining a subdivision approval begins with filing an application to the local planning board. The Planning Board will consider the application to ensure that it meets all state and local rules and regulations related to land use. Depending on the complexity of the proposal and the zoning restrictions, the application may require additional documents or reports from specialized consultants, such as environmental and traffic studies. The Planning Board will review the application and hold a public hearing to discuss the proposed subdivision. During the hearing, citizens and other interested stakeholders can voice their opinions about the proposed subdivision and its potential impacts. After the hearing, the Planning Board will decide whether to approve or reject the proposed subdivision. If the Planning Board approves the subdivision, the applicant must then make a “final plat” detailing the layout and design of the new subdivision.
