How do same-sex marriages work under the law?

In North Carolina, same-sex marriage is legal. This law, which took effect in 2015, allows same-sex couples to marry and to receive all the same rights and responsibilities as any other married couple in the state. Same-sex couples may apply for a marriage license from any county register of deeds office in the state, just like any other couple. Under the law, same-sex couples have the same rights and duties as any other married couple. This includes the right to file joint tax returns, the right to make medical decisions for one another, the right to inherit property or assets from one another, and the right to receive spousal benefits from employers. The law also allows same-sex couples to enter into prenuptial or postnuptial agreements, which are contracts between two people concerning their rights and duties in the event of a divorce or separation. These types of agreements are especially important for same-sex couples, as they allow them to govern their relationship on their own terms. Finally, same-sex marriages are subject to the same state laws governing the dissolution of marriage, including alimony, child custody, and division of property, as any other marriage. The court will consider the facts of the case and make a decision based upon what is best for the parties and any children involved.
