How do same-sex marriages work under the law?

In Washington, same-sex marriages are legal and recognized under the law just like any other marriage. The Washington State Constitution has a freedom-of-marriage clause, which states that all people have the right to marry under the laws of the state, regardless of gender. In order to get married, a person must first obtain a marriage license from the county where they plan to get married. Same-sex couples are required to meet the same requirements and paperwork as opposite-sex couples. This includes providing proof of age and identity, completing the marriage license application and obtaining blood test results if necessary. Once the marriage license is issued, the couple is free to get married in a civil ceremony or religious ceremony. The couple must have a witness to the marriage ceremony, who must sign the marriage license. Once the signed license is returned to the issuing clerk, the marriage is considered valid and effective. Same-sex couples are also eligible for the same state and federal rights and benefits afforded to opposite-sex couples, such as income tax benefits, health insurance benefits and pension benefits. In addition, certain adoption and custody rights are available to same-sex couples in Washington. In sum, same-sex marriages are recognized and respected under the law in Washington just like any other marriage. All couples must meet the same requirements to get married, and they enjoy the same rights and benefits.
