Are common law marriages legal?

In New Hampshire, common law marriages are not recognized by state law. This means that by living together, couples are not considered to be married in the eyes of the law. This is true even if couples have been living together for many years, and even if they have children together. Common law marriages used to be recognized in New Hampshire, but the last laws providing for this were repealed in 1949. Today, the only type of marriage recognized by the state is a civil marriage, which is performed by a civil authority such as a judge or a justice of the peace. In New Hampshire, it is possible for a couple to go through a common law marriage ceremony, in which they make vows to each other. However, the state will not recognize such a ceremony as a legally binding contract. To be legally married, a couple must go to a civil authority and obtain a marriage license. Despite common law marriages not being recognized, couples who are in a long-term relationship may still have some of the same rights as married couples. This may include the right to inherit property or to make medical decisions for each other. However, it is important to understand that state law does not provide the same rights as marriage. A couple should speak to a lawyer to find out how best to protect their rights as a couple.
