What is the process for getting a marriage annulled?
The process for getting a marriage annulled in Indiana requires that certain criteria be met. The party seeking annulment must demonstrate that the marriage is “void from its inception.” This means that the marriage is legally invalid and must be treated as if it never occurred in the first place. To obtain an annulment, the party seeking it must show evidence of one or more of the following legal grounds for annulment: one or both of the parties was under aged; one or both of the parties was already married when they married; one or both of the parties was temporarily or permanently mentally or physically incapable of entering into the marriage; the marriage was procured by fraud or duress; one of the parties was induced to enter the marriage by force or a threat of force; the marriage was entered into as a joke or a sham; the parties are related by blood within a certain degree of relationship; or one or both of the parties was legally incompetent to enter into the marriage. Once a party seeking annulment has established grounds for annulling the marriage, they must file a complaint for annulment in the appropriate courthouse. The complaint (and any supporting evidence) should be filed with the clerk of the court. In some cases, the court may order a hearing, after which the court may grant or deny the annulment. Depending on the situation, an annulment may be granted at an expedited rate or after a lengthier process. In either case, any marriage annulled by a court is considered to never have happened in the eyes of the law.
