Are there any legal requirements related to changing a name after marriage?
In Florida, legally changing one’s name after marriage is an option that couples may choose, however there is no legal requirement that they do so. The process of legally changing one’s name after marriage requires that the couple file a petition with their local court, in their county of residence, for a name change order. The petitioner must include proof of their marriage in the petition, along with all of their contact information. Once the petition is received, the court will issue an initial hearing date, in which the judge will review the application and determine whether to grant the name change. If the court approves the name change, the order that results from this hearing must be published in a local newspaper for a specified amount of time. After the publication period, the court must issue a second hearing date and finalize the order. Once the order is finalized, the petitioner will receive certified copies of the order and must use these when changing their name and other official documents. In addition, the court fees associated with the name change petition must be paid by the petitioner. It is important to note that while there is no legal requirement for couples to change their name after marriage, if they do choose to do so, they must follow the outlined procedures.
