What are the rights of a spouse in a marriage?
In California, married spouses have certain rights under the law. These include the right to own, manage, and dispose of property jointly, if either spouse has a job, the right to support from the other spouse, and the right to inherit from the other spouse upon death. Additionally, spouses have the right to make medical decisions on behalf of their partner if they are incapacitated and unable to make decisions themselves. They must also provide companionship, support, and comfort to one another. In the event of a divorce, spouses are generally entitled to alimony, also known as spousal support payments, which are based on the length of the marriage, the earning abilities of both parties, and other factors. Each spouse is also entitled to a share of any property obtained during the marriage. Finally, in the event of the death of a spouse, the surviving one is generally entitled to a portion of the deceased spouse’s estate. This includes the right to make funeral arrangements, apply for the deceased’s Social Security benefits, and receive life insurance proceeds. Married spouses in California have many legal rights and privileges, and it is important to understand them. While marriage is a serious commitment, understanding the applicable laws can help married couples make the most of their relationship.
