In Texas, there are laws about who can officiate a wedding ceremony. According to the Texas Statutes, only certain people are legally recognized to officiate a marriage. The people that can officiate a marriage in Texas are licensed or ordained Christian ministers, priests, Jewish rabbis, officers authorized by a court, justices of the supreme court, judges of the court of criminal appeals, justices of the courts of appeals, judges of the district, county, and probate courts, judges of the county courts at law, judges of the courts of domestic relations, judges of the juvenile courts, retired justices or judges, members of the legislature, and all retired military personnel of the grade of colonel or above. In addition to the people mentioned above, a judge or justice of the peace or certain county clerks may also be allowed to solemnize the marriage. However, county clerks are only allowed to officiate a marriage if both parties are present. There is also a special provision that allows a person to officiate a marriage if they are authorized by the State Executive Director of a religious organization and if the marriage officiant files a form with the county clerk in the county where the marriage will be solemnized. All marriages must be performed with at least two witnesses present. Additionally, all individuals who officiate a wedding must provide the couple with the marriage license prior to the ceremony. After performing the marriage, the officiant must then sign and return the license to the appropriate county clerks office in order for the marriage to be legal.
