Are there any laws regarding child support and marriage?
Child support laws play an important role in marriage law in Indiana. Specifically, when a couple either divorces or separates, Indiana law requires that the non-custodial parent must pay the custodial parent child support. The amount of child support that must be paid is determined by a formula established by Indiana law. Factors such as the parents’ incomes, the needs of the child (such as health care and educational expenses), the amount of parenting time each parent has, and other considerations are factored in when deciding the amount of the support. The court cannot deviate from the child support formula unless there is a written agreement between the parents that they mutually agree to and the court approves. The court also has the authority to order additional support, such as payments for medical expenses or educational expenses, if it finds that it is necessary. Child support must be paid until the child turns 19, or until the court orders the payments to cease. If the non-custodial parent fails to make the required payments, the court may enforce its orders by imposing penalties against the non-custodial parent, such as the suspension of driver’s license, wage garnishment, or even potential jail time. In short, in Indiana, the court takes child support obligations very seriously and requires the non-custodial parent to pay the custodial parent the amount determined by the child support formula.
