What is the legal status of medical marijuana?
In New York, the legal status of medical marijuana is that it is legal for patients with certain conditions to access and use medical marijuana. The state legislature approved the Compassionate Care Act in 2014, which legalized the use of medical marijuana for certain medical conditions. Patients may possess up to a 30-day supply of medical marijuana, as long as it is purchased from a registered medical marijuana dispensary. Medical marijuana can be prescribed for the following conditions: cancer, HIV/AIDS, ALS, Parkinson’s, multiple sclerosis, spinal cord damage, Huntington’s disease, epilepsy, inflammatory bowel disease, post-traumatic stress disorder, chronic pain, and severe nausea. Registered practitioners may also prescribe medical marijuana for any condition that they deem appropriate for treatment. Patients and caregivers must register with the state in order to obtain medical marijuana or products containing medical marijuana. Dispensaries are required to verify the identity and age of customers, verify that the person is registered with the Department of Health, and maintain records of all sales. In addition to the Compassionate Care Act, the state legislature passed a bill in 2018 that expanded the medical conditions that are eligible for medical marijuana treatment. It is important to note that recreational marijuana is still illegal in New York.
