Are there any restrictions on the advertising of medical marijuana products?

In Pennsylvania, medical marijuana products are subject to certain restrictions when it comes to advertising. The Pennsylvania Department of Health (DOH) has developed guidelines and rules which outline the regulations for advertising medical marijuana products. For instance, medical marijuana products cannot be sold or marketed as having any curative or therapeutic effects. All advertisement must also note that the product has not been approved by the FDA. Furthermore, all advertisements must adhere to the same regulations as any other pharmaceutical and must not be false, misleading or deceptive. Advertising for medical marijuana products must also be limited to approved media outlets, such as newspapers, magazines, billboards and TV or radio commercials. Additionally, all ads must showcase the official “Medical Marijuana ID Card Program” logo. These logos are issued by the DOH and indicate that a product has been approved for medical marijuana use. Medical marijuana products cannot be advertised in any public place, in public transportation vehicles, at outdoor events or within 500 feet of a school or playground. Furthermore, advertising cannot be targeted at children or young people under the age of 21. In order to help ensure that medical marijuana is safe and used responsibly, Pennsylvania has enacted a set of regulations regarding the advertising of marijuana products. All advertisers must follow the rules and guidelines set forth by the DOH in order to avoid penalties or fines.
