How does the court determine the amount of punitive damages in a medical device injury case?
In North Dakota, punitive damages are rarely awarded in medical device injury cases. Punitive damages are awarded when a defendant’s behavior is deemed particularly egregious and is intended to punish that person and serve as a deterrent. When evaluating the amount of punitive damages to be awarded in a medical device injury case, the court in North Dakota takes into consideration the plaintiff’s financial status, as well as the severity of the defendant’s misconduct. It is only in egregious cases where punitive damages are awarded.
