How do I calculate child support in a military divorce?

In North Carolina, the state uses a formula to calculate child support in a military divorce. The amount you will have to pay in child support depends on many factors, such as the income of both parents, the amount of time each parent spends with the child and other special expenses, such as childcare and school fees. When calculating child support for a military divorce, the court takes into account the military pay and other benefits an active duty service member receives, such as basic allowance for housing (BAH), combat pay, and any other type of special bonus or compensation. The court also looks into the amount of time the service member spends away from the children due to military duty. When calculating child support, the parent’s annual net income is multiplied by a factor, which ranges from 0.5 to 1.5. This factor is determined by the number of overnights the child spends with each parent during the year. Once this number is determined, it is multiplied by a percentage to determine the parent’s net monthly income. This number is then multiplied by the percentage of the children’s combined income needs to arrive at the total monthly child support to be paid. In addition, the court may also review any additional expenses related to the children such as childcare costs, medical and dental expenses, costs of school supplies, independent activity fees, and other special expenses. The court also has the discretion to order both parents to contribute to a trust fund for the children if it is deemed appropriate. The court has the final say on the amount of child support, but this formula provides a general guideline on how it will be calculated in a military divorce.
