What is mediation law?
Mediation law is a branch of California law that allows parties in a dispute to seek assistance from a neutral third-party mediator in order to resolve the issue without having to resort to legal action. The mediator is there to facilitate communication and to help the parties reach an agreement without resorting to a trial. The main goal of mediation law is to promote and maintain healthy and open communication between parties to resolve the dispute in a peaceful and amicable manner. The mediator does not decide the outcome of the dispute and does not take sides, rather their role is to act as a facilitator and help the parties come to a mutually-beneficial resolution. They are there to ensure that all parties are treated fairly and respectfully. Mediation is usually voluntary so either party can choose to terminate the process at any point if they disagree with the proposed decision or if they feel that their needs are not being met. Mediation is a great tool as it allows parties to settle disputes in a fair and efficient manner and is often preferred over going to trial. Mediation can help keep disputes out of the court system and preserve relationships between the parties, which is especially valuable when it comes to disputes between family and friends. It also potentially saves parties thousands of dollars in legal fees, as there are typically fewer costs associated with mediation.
