What happens if there is an agreement in mediation but one of the parties does not comply?

In Wisconsin, if a party does not comply with the agreement reached in mediation, it may result in a breach of contract and could be subject to legal action. If the breach is minor, the victim of the breach may decide to pursue a settlement agreement out of court. If the breach is substantial, however, the victim may seek to enforce the agreement by filing a lawsuit in court. In most cases, the parties can resolve their dispute informally in mediation before pursuing any legal action. If either party does not comply with the agreement, a court may order them to comply with specific actions. For example, the court may order the party to pay damages or follow specific procedures outlined in the agreement. The court may also issue an injunction to prevent the party from breaching the agreement again in the future. An injunction is a legal document that requires the party to do or not do something. Depending on the specific breach of the agreement, the court may also impose sanctions or financial penalties to push the party to comply with the agreement. For more serious breaches of the agreement, the court may also hold the noncompliant party in contempt. Contempt is a civil or criminal charge that can result in a jail sentence if found guilty. In conclusion, if an agreement is reached in mediation and one of the parties does not comply with the agreement, the victim may have the right to seek a court order or other legal remedies to enforce the agreement.
